An Illusion None of Us Can Afford: An Opportunity All of Us Can Embrace

We humans have many biases, but one that often asserts itself is the negativity bias, or a propensity to select, or attend to negative instead of positive information. We often expect the worst. We do this so the worst won’t happen, or so we can take steps to avoid it.

 

But often, the bias can do the opposite, and lead us to inaction. It can cause depression, or a sense of powerlessness. We can tell ourselves we can’t do anything to avoid whatever we fear will happen or to stop the dismal future we fear is inevitable⎼ even when the only thing making it inevitable is our inaction. We might hide from feeling the reality of the danger because we fear that even the thought is too much to bear; but the reality would be so much worse to face.

 

This is happening to our nation, and maybe our species, right now⎼ in the US, with the dangers of a DJT administration. We might know intellectually how awful he is but ignore what he’s telling us he will do if he wins, because we can’t believe it. Somewhere inside us, it feels impossible that such a destructive result could occur. We can’t, I can’t, believe that our world could change so drastically and get so much worse⎼ and not just the human world in the US but everywhere. But, of course, it can. If DJT somehow becomes president again, NATO would be undermined, and dictators would have even freer rein than they do now to undermine democratic nations.

 

DJT said he would invoke the Insurrection Act on day one of his imagined new administration, and use the military to make him a dictator. He’d suspend the constitution, suspend the rule of law, round up thousands, and initiate rule by him alone. It’s illegal, unconstitutional, but that has never stopped him before. We must stop him.

 

I’m not making this up. We know this. Read the 2025 Project. Listen to his speeches if you can stand it. He copies Hitler, Mussolini, etc. in his language and emotion, promises to “root out” all the “vermin,” imprison those who oppose him. He might end social freedoms, freedom of speech, voting rights, legal rights, abortion rights, workers’ rights, end legal concepts of gender, racial, and religious equality. He’d give ever more preference economically and otherwise to the rich and diminish or end government programs that serve and help most of us ⎼ he’d end Medicaid, Medicare, and Social Security, end protections in health care, end the Biden reductions in drug costs, end the EPA, privatize the US Post Office, possibly end public schools, etc. ⎼ and make the poorer 90% of us pay the costs of running his dictatorship.

 

Corruption would flourish. Incompetency. I remember when I was younger and traveling in other nations ruled by dictators. In such nations it was common for people to pay not only fees but bribes to officials to get anything done, to get a license to drive a car, to fish, to build a house, whatever. DJT has already shown a propensity for fraud and corruption. He promises to replace civil service workers, who must show competency for the position in order to get the job, with those whose only noteworthy attribute is being a blind follower of his campaign. Imagine the inefficiency of a whole government bureaucracy controlled and populated by people who’ve shown no competency in their jobs. If DJT somehow gets in office again, whatever restraints on him that were in place before would cease.

 

On Christmas, Rachel Maddow spoke with Chris Hayes about the threat posed by DJT Fascism ⎼ and the need for all of us to act, to vote, and help get out the vote ⎼ and speak to our neighbors. To speak not just to share information, but to get to know them. Create a connection, a community. Because this is our time. Not all generations are called upon to act so significantly….

Since DJT was in Office, the Political Universe Has Felt Unhinged. Maybe, Now, this is Changing: Dusk Now Has Its Sibling, A New Morning, Back

Not being able to watch DJT’s arraignment on tv, moment-by-moment, was a bummer. His legal team argued news cameras in the courtroom would create a “circus-like” atmosphere. It’s a circus-like atmosphere whenever DJT is speaking. Media organizations counter-argued that the gravity of the situation warranted full public access. The judge did allow five news-pool still photographers to snap pictures.

 

I would’ve liked to see images of him fingerprinted, for example⎼ although I could also see the value in a different viewpoint, that maybe the best thing to do is to sideline the event, sideline him, as Dahlia Lithwick argues in an article in Slate. Let him whither from lack of attention and let most of the rest of us focus on taking constructive actions to advance democracy.

 

The violence that some predicted, and that DJT himself tried to incite with calls of death and destruction, gladly did not happen. The pro-DJT morning rally was maybe 100 – 150 people, not anything in size or intent as what happened on Jan. 6. MSNBC reported that Marjorie Taylor Greene and George Santos briefly attended the rally. Greene had helped plan the rally but left quickly due to the loud noise and protests that mostly drowned out the few comments or lies she was able to utter.

 

But indicting DJT for crimes a preponderance of evidence demonstrates he allegedly committed was itself an action that advanced democracy. It had a profound effect on me, and maybe on much of the human world. It was emotional and political, but also something else; cosmological, maybe. Certainly ethical. It was about resurrecting a sense that the earth itself is spinning as it should. That cause and effect still work together.

 

Some would claim what I feel is just a yearning for revenge, but I don’t feel that very much. I feel that what DJT did, repeatedly, is shock us. To shock and use against us our sense of rightness, justice, and truth; empathy, and compassion.

 

He’s tried to shock us into seeing the world as a duality of good and evil and then rip away one side of it, so we feel the world unbalanced, unhinged, and ourselves powerless, or that no power in us can stop him. Or that he is the absolute power, not only above the law but above the very workings of nature. He used lies not just to hide the truth but to make truth impossible to argue. Or to focus so strongly on one side of the coin, one side of humanity, the back, so all we see is the backside of humanity.

 

So, when he was led to the courthouse, the unbalanced world was returned to some sense of balance. What was unhinged was now hinged to a sense of order. Dusk now had its sibling, a new morning, back. He wasn’t put in handcuffs or subjected to mugshots. But power had, in our eyes, been somewhat restored, not only to the legal system but to our sense of rightness.

 

The trial will be about DJT trying to cover up and mis-characterize in his business and tax records his payoffs to two women he had affairs with (and to one doorman who had knowledge of a secret DJT child) so news of the affairs and other negative information would not de-rail the 2016 election. In other words, he engaged in an illegal conspiracy to aid his campaign and undermine the integrity of the election⎼ and he did this in October, right before the election.

 

DJT and his GOP followers claim this indictment is a political action, created by Democrats. But Michael Cohen, DJT’s fixer, was charged by DJT’s own Department of Justice in 2018 for making these payments and falsifying his actions. Cohen pleaded guilty, the DOJ and judge accepted the plea and sentenced him to jail time. The Justice Department did not, however, charge DJT himself but showed that he had directed Cohen’s actions. So, it’s not George Soros or President Biden who initiated this case, but DJT’s own people.

 

What I and so many others are concerned about is that this is one of the lesser of his many crimes, and possibly the most difficult to prove. It would be better for advancing democracy and the rule of law if the results of the investigation into DJT’s efforts to steal the 2020 election and proclaim himself dictator, by Fulton County, Georgia, DA, Fani Willis, for example, (or the DOJ or special counsel Jack Smith) are released soon and possible charges made public. That is a clearly potent charge. And, hopefully, other indictments, a veritable avalanche of charges and evidence would soon follow.

 

Democracy is not efficient. Rule by law is not instantaneous. Fascist Dictator Mussolini claims to have made the trains of Italy run on time, but this is not totally true. Most of the changes to the Italian rail industry took place before he was in power. Mob rule can make instantaneous decisions, but few of us would like to be around when they do so.

 

We need to be glad democracy takes time to mete out justice⎼ although in this case, taking too much time might allow the GOP to further undermine the institutions of democracy itself and replace fair trials with political shows. So, we need not only a fair trial and conviction, if warranted, but one conviction after another, and this year: one example after another of justice and the power of “we the people”.

 

Now, if only the judge, Juan Merchan, would admonish DJT more fully, and hold him responsible for the threats and attacks⎼ not only against himself, but the Manhattan DA, Alvin Bragg, Democrats everywhere, and even against DJT’s former followers, like Bill Barr, who have spoken against him.

 

Over the last two election cycles, we, and so many others, have become sick of the chaos and hate DJT and the GOP manipulate, the threats to our rights and democracy. And we’re more motivated than ever to take action to stop the establishment of autocracy⎼ and to promote a fair democracy. This and the other trials to come will hopefully continue that effort.

 

 

 

Do Not Assume. Research, Then Vote: For the GOP to Claim They Care About Violence Against Most Americans Is Laughable

It’s easy to make assumptions in all areas of life. Back in 2016, many people who opposed DJT assumed he could never win and so didn’t vote at all. Who would vote for a racist, narcissistic tv personality and real estate developer except other racist developers?

 

Even today, people might assume they know what will happen in some of the elections. For example, we might assume a Democratic incumbent Governor in New York, Kathy Hochul, will easily defeat a GOP challenger who still repeats lies about the 2020 election and opposes abortion rights for women. But according to FiveThirtyEight, Governor Hochul holds, now, only a 6 point advantage in polls. 6 points is wonderful, but in New York I’d expect it to be more.

 

According to Quinnipiac, crime is the most often cited issue in the New York election and the GOP are supposedly winning that issue. Is that reporting and polling accurate? Republicans have been using it to drown out the tides of anger about their  program of taking away a woman’s right to control her own healthcare, right to abortion, and family planning, or anger about the GOP assault on voting rights and democracy.

 

The GOP have incited violent crime throughout the nation, opposed efforts to reduce gun violence, and threatened with violence anyone who opposed them, Democrat or Republican.

 

The Jan. 6 investigation revealed that DJT not only incited but tried to lead the Jan. 6 assault on our nation. Since then, there’s been a record rise in attacks on members of Congress. On Friday, 10/28, a follower of DJT, inspired by lies and hate speech against Democrats, broke into Speaker Nancy Pelosi’s home, and assaulted her husband with a hammer. Then Fox disinformation media host Jesse Watters suggested the suspected attacker, who fractured Mr. Pelosi’s skull, should be released from jail, because “people get hit by hammers all the time.”

 

The GOP leader not only incited an attack on the US Congress, but consistently acted to undermine the rule of law. States under their control suffer more violent crime than states led by Democrats. So, for them to try to pretend to care about the rule of law or stopping crime (except when it’s directed at them) or for anyone in the media to support their claim is laughable.

 

Even now, the GOP are calling on people to use the threat of violence to intimidate voters, as in Arizona where armed followers of DJT’s lies are trying to frighten voters from putting their ballots in drop boxes. The GOP are purposefully de-stabilizing society by undermining community feeling and trust, creating fear, and inciting hate in the form of racism against black, brown, and Asian-Americans, anti-Semitism, hate of LGBTQ+ people and others.

 

When we feel we have little or no power or are hurting, we might assume we know what we don’t know. The realm of what we don’t know is always infinitely larger than what we do know. We use the illusion of knowing what will happen to bury our anxiety in the face of an unknown and possibly frightening future. But this tactic can make the situation worse….

GOP Trying to Replace Constitutional Law with Vigilante Injustice

We use the expression break the law to mean violate or disobey the law. But there is also break as in break into tiny, meaningless pieces. (And violate as in abuse or rape.) The Supreme Court is actively involved in breaking the law in this second sense. GOP controlled State Legislatures and Governors are doing this. DJT is and has been breaking the law in both senses for years in his asserting that anything that serves his immediate, short-term self-interest is truth and the law, anything that opposes him is criminal and evil.

 

Dan Rather and Elliot Kirschner argued recently that the Supreme Court, which used to and is needed to represent stability, fairness, and temperance has now “become headquarters for a majority group of highly partisan, reactionary players who make clear that they are uninhibited by history, precedent, or the will of the majority of the American people.” Their actions are about asserting power, not fostering the rule of constitutional law.

 

In one decision they argued for originalism, for the impossible task of sticking with the founding fathers’ original viewpoints. This view ignores the fact that the founding fathers lived in a very different time, where slavery was legal, women and men who didn’t own land couldn’t vote. Where the weapon of choice on the battlefield was a flintlock musket, there were no computers, and the world wasn’t threatened by a climate emergency. And they were all fathers, men.

 

In another of last week’s rulings, Oklahoma v Castro-Huerta, regarding Indigenous American sovereignty, the Court went against originalism. The ruling asserted a state’s jurisdiction over crimes committed on Tribal Lands. This, as even Justice Gorsuch wrote, violates not only precedent but founding-era understanding of law.

 

In 1832 the court ruled in Worcester v Georgia that the federal government had exclusive power to manage relations with Native nations, not states. Thus, this new court ruling violated its own legal opinions and destabilizes the rule of law and the court’s function of upholding the stability of the law. Instead, it asserts minority rule.

 

A Washington Post article by Colby Itkowitz and Isaac Stanley-Becker revealed the Court has agreed to hear a case involving the “independent legislature theory,” a conservative legal theory that asserts state legislatures should have virtually unchecked power over federal elections. It would erode basic tenets of American democracy including applying the rule of law equally to everyone and basing the ultimate source of all law in the people.

 

“[I]n its most far-reaching interpretation, it could cut governors and state courts out of the decision-making process on election laws while giving state lawmakers free rein to change rules to favor their own party. The impact could extend to presidential elections in 2024 and beyond, …making it easier for a legislature to disregard the will of its state’s citizens.”

 

Texas and other states have joined in this effort to undermine the rule of law. In its 2021 anti-abortion legislation, it created a sort of vigilante justice by deputizing citizens to sue and enforce the law instead of government officials. And it would pay the vigilantes $10,000 for each successful suit. According to a New York Times article by Sabrina Tavernise, whereas if Texas had put enforcement in the hands of state officials, those officials could be sued by abortion advocates aiming to bring their case to court….

We Need to Believe Our Eyes and Ears: We Have A Manchurian President

The Manchurian Candidate is a classic movie from 1962 in which Russian Communists initiate a plot to use a brainwashed American soldier as a sleeper agent to kill the candidate for American President. Evidence would be revealed to show the Russians were responsible. The Vice-Presidential candidate, someone controlled by the Russians, would then succeed him and be able to assume dictatorial powers to safeguard the nation.

 

In the reality we face today, there is no brainwashed sleeper agent (I think), no Presidential candidate that is killed. However, as the Mueller Report made clear, a Democratic candidate and our electoral process was attacked and undermined by Russian agents to sow discord and put into office a man who now serves their interests. Many of the facts about T acting in Russia’s interest against our own have been in the news repeatedly. But it is so devastating a picture it is hard to accept. We have a Manchurian administration.

 

Just imagine what the Russian government would want from an American President. They could not defeat us militarily, so they would have to attack us from the inside. They would not just want to end our sanctions on their government but would try to destroy our democracy and turn us into an ally or puppet state.

 

They would do this by dividing our nation so much that we would be in a near civil war. They would instill fear of violence in our gathering places and schools. They would create fear in one group of all others, so this group would feel under attack and they would strike out, de-stabilizing the social fabric of the nation. And they would undermine efforts to prioritize combating domestic terrorism.

 

They would undermine the rule of law.

 

They would suppress the vote, undermining our democratic election process in fact as well as our faith in that process, and create so much chaos and confusion, fear and anxiety, that the American people would eventually want to turn to a dictator just to get some peace.

 

They would undermine our democracy further by having the President talk about not leaving office after a second term or claim violence would ensue if he lost an election or was removed from office. He’d spread lies of a cabal working against him from the inside, manipulating the election, so we wouldn’t recognize the Russian manipulators and their agents. They would begin this process by not acting to secure our own electoral integrity from Russian and other hackers. And they would get their supporters in Congress to obstruct bills requiring that contacts between politicians and foreign agents be reported to the FBI.

 

They would undermine the economy through chaotic trade policies, take away economic power from the middle class and direct it to a small group who would work with Russians for their own gain. They would act with a lack of fiscal responsibility, including running up a massive debt so the government would not be able to flexibly meet a recession or other crisis. They would politicize the Federal Reserve Board so it serves as a functionary of the T family.

 

They would undermine the free press, install propaganda networks to control information, accuse protestors of being a violent threat to law and order and thus make protest illegal.

 

They would spread so many lies they would undermine the possibility of discerning truth from fiction so Americans would not believe that what was happening was really happening.

 

They would attack anyone who opposed them, calling them treasonous, in order to create the impression traitors were patriots, and establish a de-facto dictatorship.

 

They would undermine our standing in the world, undermine the idea of democracy itself, and undermine our traditional alliances so we were isolated and distrusted. They would sing the praises of dictators, in Russia and North Korea, for example, and ally us with the same.

 

If you look at our nation today, everything above is exactly what has been happening since T was elected.

 

A Review of A Few of the Details:

 

On February 27, Michael Cohen said: “Given my experience working for Mr. Trump I fear that if he loses the election in 2020 that there will never be a peaceful transition of power…” Cohen’s revelations of Trump as possibly threatening the government, the constitution and rule of law with violence, affirms what many have suspected ever since T was elected, but it is frightening to see our fears stated so bluntly by someone who knows Trump so well.

 

Cohen is not the first to speak of this threat. Roger Stone warned America in 2017 of “insurrection” if Trump is impeached. Politico reported that Stone said, “Try to impeach him. Just try it. You will have a spasm of violence in this country, an insurrection like you’ve never seen.”

 

As the Mueller Report makes clear, the President clearly asked for and accepted Russian aid in the 2016 election. He also, once in office, cut sanctions on Russia, for example, on Oleg Deripaska, a close associate of Putin. In Helsinki, while standing next to Vladimir Putin, T sided with Putin against our own intelligence community,, claiming the Russian dictator spoke strongly in denial of the claim Russia interfered in the 2016 election. The President tore up the notes of his discussions with Putin.

 

According to Admiral Rogers, the head of the U. S. Cyber Command, Trump failed to even ask NSA how to protect our election system from hackers. The New York Times reported that Kirstjen Nielsen, before resigning as head of the Department of Homeland Security, became increasingly concerned about Russian activity in the US. But she was told by White House Chief of Staff Mick Mulvaney not to bring this up with Mr. T. As a consequence, she never met with the different cabinet secretaries to coordinate a strategy to protect our elections, nor did she inform Americans of the latest version of Russian attacks on our nation.

 

And “Moscow Mitch” has blocked any bills aimed at protecting our elections from coming to a vote in the Senate. FBI director Christopher Wray announced he shifted resources to counter the Russian threat, largely without any White House support.

 

Instead of going after the Russians who attacked us, the Mueller Report reveals T tried to get the Department of Justice to prosecute political rivals in the U. S., most notably Hillary Clinton ⎼ to avenge or protect himself, not the nation.

 

The Mueller Report documents10 times T may have obstructed justice. According to page 6 of the document, Flynn “informed the government of multiple instances, both before and after his guilty plea, where either he or his attorneys received communications from persons connected to the Administration or Congress that could have affected both his willingness to cooperate and the completeness of that cooperation. The defendant even provided a voice recording of one such communication.”

 

Mr. T has driven wedges between the US and our allies and has lowered the standing of the US in international affairs. He has failed to adequately staff and support the state department and other non-military agencies meant to protect our national security. He has also granted security clearances to people with compromised histories despite being warned of the danger these clearances could pose to our security. All of this has made us more vulnerable to attack.

 

We could go on and on with T’s criminal behavior, and behavior that threatens our democratic institutions and our humanity. T has clearly used hate to divide our nation to a disturbing degree. A Pew Poll shows that we are more divided now than in the early 1990s, maybe more divided than any time since the Civil War. He has attacked Hispanic people, African-Americans, Muslims, LGBTQ, and women, especially powerful women, like journalists or members of Congress.

 

The wealthiest among us are now so rich that 3 individuals own more wealth than half of the population. And the GOP tax cut is only making income inequality worse. T promised the 2017 tax cut would pay for itself, create a surging economy, increase wages, repatriate money hidden in foreign countries, decrease middle class taxes, but little of that has proven true. In fact, it has reduced federal income to a degree that it might threaten our economic stability and security.

 

So, if the President isn’t a Manchurian President or consciously working as an agent of Russia, he is certainly weakening our democracy and our nation. We know this, or most of us do, but we can’t let our anxiety or anger get in the way of doing all we can to sweep him out of office, by the ballot box or by criminal proceedings.
